MEMBERSHIP TERMS & CONDITIONS

PWRHAUS EMS LAB (Singapore – EMS Training Services)

1.    DEFINITIONS

1.1         “Client” refers to any individual engaging the Studio’s Services.

1.2         “Membership” refers to any recurring or fixed-term package purchased by the Client.

1.3         “Membership Fees” refer to the fees payable by the Client to maintain his/her Membership.

1.4         “Services” refer to EMS training sessions, personal training, and group classes provided by the Studio.

1.5         “Session” refers to either a scheduled EMS training appointment or a scheduled Non-EMS training appointment.

1.6         “Studio” refers to PWRHAUS EMS LAB PTE. LTD.

1.7         “Terms & Conditions” refer to these Membership Terms & Conditions.

1.8         "Commitment Period" refers to the minimum, fixed duration for which the Client agrees to maintain an active, paid membership with the Studio from the date of sign-up. The applicable Commitment Period will be clearly stated at the point of sign-up and forms part of the binding membership agreement between the member and PWRHAUS EMS LAB.

1.9         “Founding Rate” refers to the preferential, discounted membership pricing offered exclusively to the first fifty (50) individuals who register for a Founding Membership at PWRHAUS EMS LAB, as advertised on our website or through official PWRHAUS communications from time to time.

Core Terms

  1. Eligibility Window — The Founding Rate is strictly limited to the first 50 members who successfully register and complete payment for a Founding Membership. Membership numbers are allocated on a first-come, first-served basis, determined by the timestamp of successful payment (not booking or inquiry). Once the 50th slot is filled, the Founding Rate offer closes permanently and cannot be reinstated, extended, or offered again under any circumstance, regardless of future promotions.

  2. Lifetime Rate Lock — Once secured, the Founding Rate is honored for the lifetime of the member's continuous membership with the Studio. It will not increase due to future pricing changes, rate revisions, or new membership tiers introduced after the Founding Membership Period closes.

  3. Continuity Requirement — The Founding Rate remains valid only while the membership stays active and continuous.

2.    MEMBERSHIP TERMS

2.1         Membership Commencement

All memberships (except Founding Memberships) are valid only for the duration of the respective membership commitment period and will expire automatically upon their completion unless renewed by the Client.

2.2         Founding Membership – Special Terms

In the event a Founding Membership is cancelled or terminated by the Client, should the Client wish to re-join the Studio in the future, membership will be offered at the prevailing standard membership pricing at that time, and the original Founding rate will not be reinstated.

2.3         Non-Member / Drop-In Packages

For non-member packages, the validity period commences upon the booking of the Client’s first session, and not from the date of purchase. Unused credits within a non-member package will expire at the end of the stated validity period and are non-refundable.

2.4         Minimum Commitment

Where applicable, the Client’s Membership is subject to the Commitment Period as set out in his/her Membership tier.

2.5         Membership Credit Refresh

Membership session credits used for booking Sessions are refreshed on a monthly basis, aligned with the Client's recurring billing date. Unused credits from the previous billing cycle do not carry over or roll forward, except as expressly provided below.

Exception for Founding Members: Notwithstanding the above, Clients holding an active Founding Membership are entitled to roll over unused session credits from one billing cycle to the next, for as long as their Founding Membership remains active and continuous.

1 EMS Session = 2 Credits

1 Non-EMS Session = 1 Credit

1 Paid Special class/Exclusive class type = 3 or 4 Credits (where applicable)

2.6         Non-Transferability

Membership, as well as any Sessions and/or credits, is personal to the Client and strictly non-transferable and non-shareable. Any unauthorized sharing of Membership may result in immediate termination of the Membership without refund of any Membership Fees paid upfront.

2.7         Usage Limits

The Client shall comply with the weekly Session limit prescribed by the Studio for the applicable Membership tier, being the maximum number of Sessions the Client is entitled to attend per calendar week. Any unused Sessions shall lapse at the end of the relevant week and shall notroll over or accrue unless otherwise expressly agreed by the Studio in writing.

2.8         Payment Obligation

a.         Membership Fees are payable monthly in advance and shall be automatically charged on a recurring basis to the payment method designated by the Client at the time of enrolment. The Client will not be allowed access to the Studio where there are Membership Fees outstanding.

b.         The Client agrees to maintain a valid payment method on file at all times and authorizes the Studio to deduct the applicable Membership Fees from the designated payment method on the same date of each billing cycle.

c.         If any payment is declined or is otherwise unsuccessful, the Studio reserves the right to suspend or terminate the Client's access to its facilities and Services until all outstanding amounts are paid in full. The Studio may also charge reasonable administrative or late payment fees in respect of such unsuccessful payments.

d.         Early termination by the Client prior to the completion of the membership’s respective commitment period is subject to an early termination fee of SGD 300, applicable across all standard membership types, with the exception of Founding Memberships.

e.         Early termination requests must be submitted in writing to the Studio and will only take effect upon confirmation from the Studio, along with settlement of early termination fee (where applicable).

f.         Membership Fees paid are non-refundable, regardless of unused Sessions, missed bookings, or the Client’s inability to attend Sessions.

3.    STUDIO POLICY AND BOOKING & ATTENDANCE RULES 

3.1.        Studio Policy

The Client agrees to adhere to any Studio policy as may be notified to the Client and/or as set out on www.pwrhaus-ems.com . The Client further acknowledges that the Studio may update such Studio policy, as well as class structures and scheduling systems, from time to time as deemed required by the Studio. Such updates shall not affect the core entitlement or commitment duration of the Membership.

3.2         Punctuality

Where the Client arrives after the commencement of a Session, the Studio reserves the right, at its sole discretion, to refuse the Client entry or participation where reasonably necessary to ensure safety, Session quality, or operational reasons. [In such an event, the Session shall be deemed forfeited and no refund, credit, replacement Session or rescheduling shall be provided.]

3.3         Instructor Authority

The Client acknowledges and accepts that participation in the Session, including the use of EMS technology, involves inherent risks and requires the Client to comply strictly with all instructions, directions and safety protocols issued by the Studio and its trainers at all times.

4.    CANCELLATION & NO-SHOW POLICY

4.1         Cancellation Window

Any cancellation of a Session must be made no less than 12 hours prior to the scheduled commencement time of the Session.

4.2         Late Cancellation

Any cancellations made after the cancellation window stated in Clause 4.1 above shall result in forfeiture of the relevant Session credit.

4.3         No-Show

Where the Client fails to attend a booked Session, the Session shall be deemed a no-show and will result in forfeiture of the relevant Session credit.

4.4         Studio Cancellation

In the event the Studio cancels a Session, the Client shall be entitled to a replacement Session or credit.

5.    FREEZE / SUSPENSION POLICY

5.1         Eligibility

Subject to the Studio’s approval, the Client may by prior notice in writing to the Studio request to freeze his/her Membership (“Freeze”) in the event of:

a. illness or injury, as evidenced by a valid doctor’s medical certificate; or

b. travel, as evidenced by flight or other relevant travel itinerary. 

5.2         Duration

The cumulative Freeze duration shall not exceed:

·    2 weeks for Memberships with a 6-month commitment (POWER tier); and

·    4 weeks for Memberships with a 12-month commitment (ELITE tier).

Exception for Founding Members: Notwithstanding the above caps, Clients holding an active Founding Membership shall not be subject to any cumulative Freeze duration limit. Founding Members may Freeze their Membership for any duration, whether in a single continuous period or across multiple non-consecutive periods, for as long as their Founding Membership remains active and continuous.

5.3         Effect of Freeze

Membership billing shall continue as scheduled during the Freeze period, and the Membership term shall be extended by a duration equivalent to the approved Freeze period which includes the reimbursement of credits respective to the Freeze period.

5.4         No retroactive application

No Freeze period shall be applied retroactively.

6.    TERMINATION POLICY

6.1.        Termination by Client

a.         The Client may terminate his/her Membership by providing no less than 14 days’ prior written notice to the Studio before the next recurring billing date.

b.         Where the Client elects to terminate the Membership before completion of the applicable Commitment Period, the Client shall be liable to pay an early termination fee of SGD 300, in addition to any outstanding fees accrued up to the effective termination date.

c.         Termination shall only take effect upon:

·     expiry of the 14-day notice period; and

·    settlement of all outstanding fees, including any applicable early termination fee.

d.         The Studio reserves the right to suspend the Client’s access to the Studio in the event that any payment remains outstanding.

e. Exception for Founding Members: Notwithstanding sub-clauses (a) to (d) above, Clients holding an active Founding Membership are not subject to any Commitment Period and shall be exempt from the early termination fee of SGD 300 stated in sub-clause (b). Founding Members may terminate their Membership at any time by providing no less than 14 days' prior written notice to the Studio before the next recurring billing date, subject only to settlement of any outstanding fees accrued up to the effective termination date. For the avoidance of doubt, this exemption applies exclusively to the Founding Membership and does not extend to standard POWER-tier or ELITE-tier memberships.

6.2.    Termination by Studio

The Studio reserves the right to terminate the Client’s Membership for:

·           any material breach of these Terms & Conditions;

·           persistent breach of these Terms & Conditions, where the breach is capable of remedy but not remedied by the Client within 14 days of notice from the Studio;

·           where any part of the Membership Fees remains unpaid 30 days after falling due;

·           where the Client has provided information he/she knows to be false when signing up for Membership;

·           conduct deemed by the Studio to be unsafe within its premises; and/or

·           abusive behaviour towards Studio staff or other members.

7.    EMS MEDICAL SCREENING & ELIGIBILITY

7.1.    Mandatory Screening

The Client must complete the EMS Medical Screening (PAR-Q) form as set out in the Annex as a pre-condition to Membership.

7.2.    Disclosure Obligation

The Client must fully disclose all relevant medical conditions, including but not limited to:

·    cardiovascular conditions;

·    neurological disorders;

·    implanted medical devices (e.g., pacemakers);

·    pregnancy; and/or

·    recent surgeries.

7.3         Contraindications

Any Client with contraindications may be restricted from participating in Sessions or denied Membership. Such contraindications are set out as follow:

a.             Absolute Contraindications

(Participation is strictly prohibited unless cleared by a medical professional)

·    Cardiac pacemaker or implanted electronic devices

· Pregnancy

·    Severe cardiovascular disease

·    Epilepsy (uncontrolled)

·    Acute infections or fever

·    Recent thrombosis or embolism

·    Active cancer or undergoing chemotherapy (unless medically cleared)

b.             Relative Contraindications

(Participation may be allowed with caution and/or medical clearance)

· Controlled hypertension

· Diabetes

· Recent surgery or injury

· Metal implants (non-electronic)

· Chronic back pain or joint conditions

· Hernia

· Skin sensitivities

7.4         Ongoing Responsibility

The Client understands and acknowledges that failure to disclose relevant and accurate medical information may result in serious injury, and shall inform the Studio immediately of any changes in his/her medical or health condition.

8.    ASSUMPTION OF RISK & LIABILITY WAIVER

8.1.        Inherent Risk Acknowledgement

The Client acknowledges that EMS training involves electrical muscle stimulation, which may place stress on muscular and cardiovascular systems. There are therefore inherent risks to the Client’s participation in such training Sessions, including but not limited to the risk of experiencing:

·        muscle soreness;

·        fatigue;

·        skin irritation; and/or

·        injury.

8.2         Voluntary Participation

The Client voluntarily participates in Sessions at his/her own risk. The Client shall monitor his/her physical condition at all times and exercise to an appropriate level based on his/her knowledge of his/her health and any medical advice received.

8.3         Release of Liability

To the fullest extent permitted by law, the Client agrees to release and discharge the Studio, its employees, and agents from any loss, liability or damage arising from or connected with the Client’s participation in any activity at the Studio, including but not limited to the Sessions, except in cases of gross negligence or willful misconduct.

8.4         Indemnity

The Client agrees to indemnify the Studio against claims arising from:

·        undisclosed or inaccurately disclosed medical conditions;

·        misuse of equipment; and/or

·        failure to follow the Studio’s instructions in the participation of Sessions.

8.5         Warranty

The Client warrants that all information provided to the Studio for the purposes of the Membership is true, complete, and accurate, and no information that may affect his/her participation or Membership enrolment has been withheld.

9.    GARMENT HYGIENE & EQUIPMENT POLICY

9.1.        Training Attire

The Client must wear EMS undergarments or attire (“EMS Suits”) as provided by the Studio and shall not tamper with the EMS Suits or EMS equipment.

9.2.        Hygiene Standards

The Client shall maintain proper hygiene when in the Studio, including but not limited to in his/her use of any EMS Suits provided by the Studio. The Studio reserves the right to refuse participation for hygiene concerns at the Studio’s discretion.

9.3.        Garment Usage

EMS Suits provided by the Studio must be handled with due care. The Client shall be liable for any damage to the EMS Suits arising from misuse, negligence or failure to follow the Studio’s instructions, and the Studio reserves the right to impose reasonable repair or replacement charges in respect of such damage.

9.4.        Laundry Protocol

The Studio maintains industry-standard cleaning procedures for the EMS Suits it provides.

10. STUDIO RULES & CONDUCT

10.1.     The Client shall conduct him/herself respectfully towards Studio staff and other Studio members and in accordance with Studio policy.

10.2.     The Studio reserves the right to refuse entry to or remove any Client whom the Studio deems is engaging in disruptive, unsafe or otherwise inappropriate behaviour within its premises and/or towards Studio staff or other Studio members.

11. DATA PROTECTION 

11.1.     The Client consents to the Studio collecting, using, disclosing and/or processing the Client’s personal data provided to, or obtained by, the Studio in connection with the Client’s Membership for purposes including Membership registration and administration, Session bookings, communications, Service delivery, payment processing, operational management and such other purposes reasonably related to the Studio’s provision of the Services.

11.2.     Such personal data as set out in Clause 11.1 above shall be handled in accordance with the Personal Data Protection Act 2012 (2020 Rev Ed) and the Studio’s data protection policy (available at www.pwrhaus-ems.com).

11.3.     The Client may access, correct his/her personal data or withdraw consent to the collection, use or disclosure of his/her personal data by giving written notice to the Studio at hello@pwrhaus-ems.com . 12. GOVERNING LAW AND JURISDICTION

12.1.     These Terms & Conditions shall be governed by the laws of Singapore.

12.2.     The Client and the Studio agree to submit to the exclusive jurisdiction of the Singapore courts all or any disputes arising out of or in connection with these Terms & Conditions, including any question relating to their existence, validity or termination. 

13. AMENDMENTS

13.1.     The Studio reserves the right to make reasonable amendments to these Terms & Conditions at any time by posting the amended Terms & Conditions on the Studio’s website or by providing a copy of such amended terms to the email address furnished by the Client or as notified by the Client from time to time.

13.2.     The amended Terms & Conditions shall be effective immediately upon being posted on the Studio’s website. The Client’s continued use of the Services following the posting of any amended Terms & Conditions shall be deemed to be the Client’s acceptance of the amended Terms & Conditions. 

By signing up for a membership or package with the Studio, the Client acknowledges and agrees to the Terms & Conditions outlined above.
